What happened: bail rejected in the Pulwama suicide attack case
A special National Investigation Agency (NIA) court rejected the bail application of Insha Jan alias Insha Tariq, an accused linked to the 2019 Pulwama suicide attack. The 2019 Pulwama suicide attack killed 40 Central Reserve Police Force (CRPF) personnel.
The court’s stated reasons were twofold: Prima facie presumption: the court said there was sufficient material on record to presume that the allegations are prima facie true (prima facie means “at first sight,” based on initial evidence).UAPA bail restriction: the court held that the bail restriction under Section 43-D(5) of the Unlawful Activities (Prevention) Act (UAPA), 1967 applied, preventing release at this stage.
Insha Jan alias Insha Tariq is a resident of Harkipora village in Pulwama district and was arrested on March 3, 2020.
Background and earlier position: why bail becomes harder under UAPA
In cases involving the UAPA, bail is not treated like ordinary criminal bail. Section 43-D(5) of the UAPA, 1967 creates an additional constraint on courts when deciding bail in certain offences under the Act.
