What happened
The Karnataka High Court adjourned further proceedings on a petition filed by Shivashankarappa S. Sahukar challenging the Governor’s order suspending him as chairperson of the Karnataka Public Service Commission (KPSC). The court will examine the legal interpretation of Article 317(2) of the Constitution and the scope of the Governor’s power to suspend a State Public Service Commission chairperson pending inquiry.
The suspension followed allegations that Sahukar’s daughter obtained a reserved government job using a fake income certificate.
UPSC may test the scope of the Governor’s power to suspend a State Public Service Commission chairperson or member, the procedural safeguard of inquiry, and the role of judicial review in protecting constitutional bodies from arbitrary action.
