What happened in the Supreme Court
The Supreme Court considered whether the “lead case” question in the Krishna Janmabhoomi–Shahi Idgah mosque dispute should be referred back to the Allahabad High Court. A Bench of Justices Sanjay Kumar and Sanjeev Sachdeva recorded that parties had indicated informal discussions among Hindu plaintiffs about which suit must be treated as the lead case. The Supreme Court adjourned the hearing to 2 September.
The Supreme Court signalled it was inclined to remand the lead-case issue to the Allahabad High Court. Senior advocate Shyam Divan urged the Supreme Court to remand the lead-case question for fresh consideration.
Background and earlier position
The Supreme Court was hearing a plea by a Hindu party challenging a 2025 order of the Allahabad High Court in the Krishna Janmabhoomi–Shahi Idgah mosque dispute. The challenged order treated another Hindu party’s suit as representative of all devotees of Lord Krishna.
The Allahabad High Court, on 18 July, allowed an application of another Hindu party to be treated as the representative of all devotees. After the 18 July order, suit number 17 was to be heard and decided first as the representative suit.
