Legal experts stated that a Union government assurance that no punitive action would be taken cannot override statutory provisions governing investigation and prosecution once an FIR is registered.
Legal experts explained that after FIR registration, the investigating agency may file a closure report if it finds no material, or the public prosecutor may seek withdrawal in accordance with law.
Legal experts stated that judicial scrutiny remains necessary because courts can reject a closure report after hearing the complainant, and withdrawals before judgment require giving victims an opportunity to be heard.
Legal experts stated that the Solicitor-General’s submissions in the hearing did not refer to any amnesty assurance; instead, the submissions described violence allegations as linked to anti-social elements and miscreants infiltrating demonstrations.
