What happened (EC’s stand before the Madras High Court)
The Election Commission of India (EC) informed the Madras High Court that it will not notify byelections for five Tamil Nadu Assembly constituencies until election petitions relating to the returned candidates are disposed of. The EC’s submission came in proceedings before the First Division Bench of Chief Justice Sushrut Arvind Dharmadhikari and Justice G. Arul Murugan.
The Madras High Court proceedings were triggered by a public interest litigation filed by K. Venkatachalapathy of Tirunelveli through counsel V.R. Shanmuganathan. EC standing counsel Niranjan Rajagopalan filed the counter-affidavit describing the EC’s intention not to announce or notify by-polls while the election petitions are pending.
The constituencies for which EC stated it does not intend to notify byelections are Tiruchi East, Perundurai, Ambasamudram, Viralimalai and Karur.
